Although I generally loathe and despise unions, the feds have no constitutional authority to regulate states here. The feds need to butt out. This is an issue of constitutionally sovereign states not a federal issue.
Guess it doesn’t matter in the long run,unions are dinosaurs.
The State doesn’t have the right to take away constitutional rights from workers or employers any more so than any other constitutional rights.
The States have to obey the First Amendment just as much as the federal government must obey it.
State government forcing it's people to pay some favored 3rd party as a condition of employment is unconstitutional on its face.
The First Amendment is not a sovereign state issue.
The best argument here is that the federal government had to enact the 13th Amendment to outlaw slavery in the individual states.
“Abolishes slavery, and involuntary servitude, except as punishment for a crime.”
This applies to forced union dues, forced artistry against a person’s religious beliefs, the forced payment of employee insurance to fund birth control and abortion against a person’s religious beliefs, and the forced purchase of individual health insurance.
So, backed by the spirit of Abraham Lincoln, President Trump is once again fighting against the involuntary servitude still sponsored by the Democrats.
Extortion is a federal issue too.
Regulation of Interstate Commerce trumps the 10th amendment so it is clearly a federal issue.
