This afternoon Glenn Reynolds posted this comment from a former judge and reader on the General Michael Flynn arrest and plea deal.
Glenn believes this was a flawed investigation because General Michael Flynn was not notified that the main witness against him was removed from the investigation for bias. If General Flynn was not aware of this it is Giglio violation. Via Instapundit:

Did the prosecution tell Flynn’s lawyer that their main witness against him was removed for bias? Since Strzok led the interview and his testimony would be needed to establish untruthfulness, he is a critical witness not just a prosecutor. If not disclosed, would this not be a Giglio violation? This is the kind of misconduct that can get a case dismissed and a lawyer disbarred. It is a Constitutional violation. This has bothered me since I heard about it.

The Giglio versus United States case: is a United States Supreme Court case in which the Court held that the prosecution’s failure to inform the jury that a witness had been promised not to be prosecuted in exchange for his testimony was a failure to fulfill the duty to present all material evidence to the jury, and constituted a violation of due process, requiring a new trial.

As much as I dislike the Clintons, attacking the independent counsel was a very effective strategy...and Flynn is a very sympathetic figure.

If Mueller had disclosed this info to Congress months ago then he would not have been able to get Flynn’s conviction. Therefore, Herr Mueller is guilty of obstruction and should be disbarred.

I don’t have the link, but I’m sure I read in just the past day or so that several GOP conservative donors have gotten together to raise funds for Flynn.
Reminds me of Mike Nifong of fake Duke Lacrosse rape fame.
The question is whether Giglio applies in a guilty plea situation versus a trial on the merits?

True enough, but this smells funny. many attorneys do pro bono work and there are judicial organizations like Judicial Watch that have money for this type of case. Why would Flynn be left to twist in the wind. Flynn was railroaded from the start and never should have met with FBI without an Attorney. He is not that stupid and not that broke. Flynn’s behavior is curious. He knows better than to do this. Flynn makes Scooter Libby look like a medal of honor winner and Flynn look like a self serving sleaze ball.
Makes me wonder......Was Flynn actually flipped by the deep state before he met with FBI because his family was threatened? FBI, democrats, white house and Justice dept. All were surveilling Trump and campaign this case could have been orchestrated from before Trump even won the election. No facts here I’m just musing. We are in perilous times and deceit is universal at this point.
