Conservatives have a new court-packing plan, and in the spirit of the holiday, its a turducken of a scheme: a regulatory rollback hidden inside a civil rights reversal stuffed into a Trumpification of the courts. If conservatives get their way, President Trump will add twice as many lifetime members to the federal judiciary in the next 12 months (650) as Barack Obama named in eight years (325). American law will never be the same.
The outer turkey in the plan is the ongoing Trumpification of the courts. In the final two years of Obamas presidency, Senate Republicans engaged in tenacious obstruction to leave as many judicial vacancies unfilled as possible. The Garland-to-Gorsuch Supreme Court switch is the most visible example of this tactic but far from the only one: Due to GOP obstruction, the number of [judicial] vacancies . . . on the table when [Trump] was sworn in was unprecedented, White House Counsel Donald McGahn recently boasted to the conservative Federalist Society.
Trump is wasting no time in filling the 103 judicial vacancies he inherited. In the first nine months of Obamas tenure, he nominated 20 judges to the federal trial and appellate courts; in Trumps first nine months, he named 58. Senate Republicans are racing these nominees through confirmation; last week, breaking a 100-year-old tradition, they eliminated the blue slip rule that allowed home-state senators to object to particularly problematic nominees. The rush to Trumpify the judiciary includes nominees rated unqualified by the American Bar Association, nominees with outrageously conservative views and nominees significantly younger (and, therefore, likely to serve longer) than those of previous presidents. As a result, by sometime next year, 1 in 8 cases filed in federal court will be heard by a judge picked by Trump. Many of these judges will likely still be serving in 2050.

Pack my ass, they are vacancies and his job to fill!
Great reply re the financial realities of 2017-2015!
“.....nominees with outrageously conservative views...”
No bias there
“We all best hope they dont turn out to be wolves in sheep clothing”.
Yeah that’s a worry. I thought about it before posting, but then thought what if Hillary was appointing these judges.
That is why AL has two things to get done, win today’s Iron Bowl and vote in next month for Judge Roy Moore. For the latter, it is all about the USSC.
One caveat to what you wrote: Alabama probably will lose a congressional seat, and certainly will not gain a seat, following the 2020 Census. But NC certainly will gain a seat, and the GOP will control redistricting there (even if the RAT Governor steals the gubernatorial election again in 2020, his veto power doesn’t extend to redistricting bills).
When will the 9th Circus have a vacancy?
Yep.
I described the outcome of 2020 in a follow up post couple months ago.
We lose reps in a few states but, make gains in others.
The funny part is AL loses a rep but, stays Red so, we keep the momentum.
Texas gains a rep or two and my prediction, based on my original post, is Texas stays Red 10
+ years.
Except for the red diaper babies in Austin but, their blood is full of hemoglobin and they only way they vote red is seeing an economy do8ng so well they will vote in their self interest and give their ideology a pass....maybe....amd maybe monkeys fly outta my bass....
But, if people who had reliably voted Republican can vote a mediocre Marxist, then maybe a Marxist would rather see the captain who started us on this journey with his hand on the tiller.
I wonder if the WaPo has ever, in it's whole printing history, used the term “outrageously liberal views” :^)
Rep. Samuel B. Pettengill, (D), Indiana: A packed jury, a packed court and a stuffed ballot box are all on the same moral plane. This is more power than a good man should want or a bad man should have.
“NeverTrumpers were willing to hand the judiciary to Hildabeast?”
NeverTrumpers are just sellout globalists on the take. I hate them with a passion.
Hopefully! Actual "American" law was phased out starting around 1903 and completed during 2009.
The return to American law is now a distinct possibility...
Face it liberals. Obama was LAZY.
Go Donald Go !!!!
That’s a great quote.
Yep. I think everyone is assuming that our slim majority in the Senate actually means something.
Why not divide the 9th circuit into three circuits and raise the SCOTUS to 11?
This has to be at least in part Sessions’s doing, right?
I mean, the nominations have to come from the admin, and that must be the DoJ, no?
And Sessions having long been in the Senate knows intimately what is needed to get nominees confirmed and presumably has the relationships to help see that done.
Actually, Trump can’t pack the courts. He can only fill open seats. I’ve heard the 9th might be split because it covers too great a population and geography compared to other districts. If that were to happen President Trump would get extra seats to fill. But that was a discussion before he took office.
