Pretty sure the standard for resigning (in an actual Republic where a moral/criminal code still applied) would be subordniate to the standard for making an arrest given evidence that a violation of the criminal code had occured.
For Example, a violation of the UCMJ:

(g) Definitions. In this section:
(2) Sexual contact. The term sexual contact

(A) touching, or causing another person to
touch, either directly or through the clothing, the
genitalia, anus, groin, breast, inner thigh, or buttocks

or degrade any person; or...
(8) Consent.

(B) A sleeping, unconscious, or incompetent person cannot consent. A person cannot consent to force causing or likely to cause death or grievous bodily harm or to being rendered unconscious.
