IRS calls it a “silent return”. when nothing is checked on line 61 indicating whether you had coverage for the whole year or not.
They were sidelining silent returns this year after the E.O..
The IRS doesn’t know what to do so they send a letter asking the question to the taxpayer. They say they are trying to follow the law. In their view, the law must be changed or altered in order for them to follow it.
Quite frankly the law needs to be changed. How does IRS program their computers for an E.O.?
I’m not defending them, I’m just telling you what their logic is. They also wait on Congress every year for extender legislation and cannot program their computers until late December. The real problem is in Congress.
