This was a 1-0 decision. Justice Kennedy covers the Ninth Circuit, so any requests for a stay coming from that circuit go to him. He can grant or deny it, or refer the request to the full court. He chose to grant it.
It’s time for Kennedy to retire so we can assure somebody young takes his place why we still have a majority in the senate.
