I think the key here is “based on available evidence.” The evidence was very thoroughly destroyed and they know it.

Regarding the article title, Ms. Lerner was not cleared. A decision was made to not prosecute. Neither was HRC “exonerated” when Comey chose to not prosecute.
You notice a lot of these decisions are made during these hurricanes. They (whoever these swamp monsters are) will never let a bad situation go to waste.

After 4 hrs on the phone with them, even the IRS said it was fabricated.
Refusing to prosecute is not the same as cleared of any wrong doing.
