California AG Claims Rescinding DACA is Unconstitutional

President Donald Trump argued Tuesday that his predecessor’s Deferred Action for Childhood Arrivals (DACA) program “is unlawful and unconstitutional and cannot be successfully defended in court.”

But California Attorney General Xavier Becerra, who has vowed to lead the so-called “Resistance” to Trump, argued the opposite, claiming that the president’s decision to rescind DACA Tuesday was unconstitutional — though he did not explain why.

“We believe the Trump administration has violated the Constitution, federal law, and certainly we believe wholeheartedly the Trump administration has ignored the American people,” Becerra said, according to the Fresno Bee.

He threatened to sue the administration over rescinding DACA, echoing comments by New York’s governor and attorney general — though none of them explained clearly what part of the Constitution Trump had violated.

This is funny. California Attorney General Xavier Becerra, in addition to being legally ignorant, is apparently also legally illiterate. He never read the 0bama regime's own briefs in defense of the similar DAPA program. The government never claimed it was required to have a DAPA/DACA program. It was entirely a discretionary act of the Executive. If the Executive had the discretion to start it, he has the discretion to end it.

Former Democrat Cong Xavier Becerra is California's top L/E officer. As a Congressman funded w/ our tax dollars. Becerra's employment of Imran Awan (now under indictment for bank fraud) raises serious questions about Becerra's law enforcement abilities and his qualifications for high office.

ITEM--- The Awan clan is under investigation for double-billing Congress, for stealing House members' electronics for resale, for placing no-shows on the House payroll, and for defrauding the Congressional bank.

<><> Did Becerra ever sign off on his employee Awan's dealings w/ the Congressional bank?

<><> Did Becerra ever file a police report about missing/stolen govt-issue IT equipment?

<><> Did Becerra personally supervise Imran's IT work?

<><> Did Becerra actually see Imran performing IT ork?

<><> Did Becerra ever knowingly pay Imran tax dollars even though Imran was conducting several of his personal businesses elsewhere?

<><> Did Becerra ever file a police report about falsified official govt documents and that tax dollars went missing due to ghost employees Imran placed on the Congressional payroll?

Most egregiously, did Becerra ever issue a warning to his constituents that their emails and private info had been compromised?

NOTE: The Awan clan had access to all of Becerra's emails and Congressional correspondence. This means they have Becerra's constituents' SS nos and personal info.....b/c constituents are required to give the member their SS no when corresponding w/ the member.

Becerra has to be one of the most brainless individuals who has ever held the title of AG for any state. His grasp of the Constitution is Zero. With a-holes like him, there is no avoiding a civil war.

Lawfare is a form of asymmetric warfare consisting of using the legal system against an enemy, such as by damaging or delegitimizing them, attacking them financially, delaying the execution of their lawful actions, or winning a public relations victory. The Democrats suggested they would utilize this strategy just after the election, and they have been using it ever since. They have been using this to attack Executive Orders, now this. What could be done to fight this, other than expediting path to Supreme Court review? It is an utter waste of time and resources to fight each of these nonsensical claims.

NOT JUST CA: Eleven states and the District of Columbia filed a lawsuit Wednesday against President Trump’s decision to roll back the previous administration’s Deferred Action for Childhood Arrivals program.

“The president has made numerous statements on the campaign trail and in office disparaging Mexicans,” Washington State Attorney General Bob Ferguson (D) said in announcing the suit. “We allege the president’s own statements make clear that DREAMers are being targeted based on their national origin.”

See my earlier post this thread, this is coordinated “lawfare”. We need a strategy to stop this in its tracks.
