As to suing...MAYBE they could have stopped it, but our record on stopping Obamacare, especially in the second lawsuit, which was totally based on the ACTUAL WORDING of the bill that passed*...yet we still lost, the outcome would be far from certain.
*In that Supreme Court ruling, the wording was clear as day - no subsidies to states that didn’t set up their own exchanges. The wording was there to force states to put some skin in the game, but many didn’t...yet Obama kept the subsidies rolling in to those states (to prevent a complete collapse of the plan).
One of the conservative justices asked: “Couldn’t you just have Congress change the wording a bit (to strike that requirement for state-run exchanges)?” The Obama Administration official responded with “This Congress?”. They all had a nice big laugh and the Supreme Court decided that they needed to change the law themselves, since there was ‘no hope’ of Congress changing the law - and the court did indeed change the law.
DAPA was stopped by a lawsuit by the states, the GOP Congress could have spared us all this drama, but they wanted amnesty any way they could get it.
