Do the just let victims bleed to death in UTAH cuz how else would they know their blood type if they don’t draw their blood.

She was stopping the officer from taking a blood sample from an unconscious, injured patient... a sample that was medically unnecessary and only being sought for legal purposes.

You don't know American history.the history of the police here, which precludes every single stupid argument you keep throwing up.

FYI...there are rotten apples in every single line of work; police are no exception. And this nation has laws on the books which the police ( and those who tell them what to do ) either enforce, or ignore.

Since you really have a fly up your nose re "cops", I suggest, yet again, that you get the hell out of this country, go find the UTOPIA, that you so yearn to live in, and and also find a site better suited to your obsessive hatreds and lack of factual knowledge.

Samples had already been drawn. Why didn’t just send him to her supervisors? Any hospitals I’ve worked at nurses didn’t deal directly with the police. Especially if this guy came in acting like an a-hole, which I suspect he did.

If you’re referring to why the nurse was dealing with the cop...maybe she was the charge nurse, or at least the nurse dealing with the comatose patient.

Article did not say that. Article point blank they can’t draw blood without consent and attributed that assertion to the nurse.

Under the law there is a vast difference in doing tests as a part of medical care and doing tests for LE. A doctor would be ordering the tests for medical care for an unconscious patient, not LE. Even if the hospital does tests for medical reasons and LE wants the results they have to obtain them legally. If the hospital would have needed to check patient for alcohol or drugs for medical reasons that does not mean the LE have access to them. That would be a legal issue, they would still need a warrant or consent of patient.

Some states have laws that mean you give consent to this type of thing automatically by agreeing to it in advance when you get your license and drive. It is considered implied consent to drive in those states. That is the only way LE can do it without consent or warrant. According to all the articles I have read about this Utah does not have implied consent law. That is what was being discussed by the nurse with the officer and her supervisor by phone when this LE arrested her. The fact that there was no implied consent law.

We don’t give up our Constitutional rights just because we are getting medical care or are unconscious.

I just talked to my daughter who is a nurse and at one point worked in the county jail as a nurse about this incident. Even at the jail LE had to have consent of patient or get a warrant before medical personnel could legally draw blood in these circumstances. That is at the jail!

This LEO was so far out of line, there will be millions paid out in lawsuits for his behavior. None of this is new either, things have worked this way a long time. LE is aware of it, or should have been- he was just trying to bully through someone and get his own way.

The sad thing is we the people pay not only the money for his unprofessional actions- but if he had bullied her into doing it any case they would have had would have been thrown out and if the patient was under the influence of drugs or alcohol he would have been free to continue to do that.

LE are just like everyone else, there are good and bad officers. That is just the truth of it. I support good LEO and most that I have ever dealt with have been professionals. I do not support the bad apples.

Makes no sense. If so, no one, for example, taken unconscious to an ER room could have blood taken.

Why have militarized raids increased 20-40 fold at the same time violent crime and machine gun ownership has gone down? Why are they raiding people for tiny grows with machine guns AND billing us ABSURD amounts of money for it?

Why have these cops I mentioned not been punished, why are there so many coverups in departments and why do so many other cops allow this garbage to occur?

If all the cops in that room didnt immediately file a complaint, they should be be fired too! Every penny of lawsuit money for these poor people should be taken from cop assets. NOT taken from us taxpayers as is currently done.

I want to learn so Please educate me with your great knowledge of America and explain how all of this grubby trash is in any way American!

She was telling him what the hospital policy- based on current law- was in regard to tests for LE. She was not speaking to a doctor about the patient’s medical care, she was speaking with LEO about the legal issue of them getting a blood draw or the results of if one had already been done.

This cop is a grand jerkoff who needs to be fired ASAP! It appears he was in a CYA mode and wanted the victims blood sample to fudge. He ran into a citizen who was following the rules and was not respecting his power trip authority. Fire the cop now! It will be interesting to see how the PD handles this A$$hole.

Ok, but that is NOT what the nurse is reported to have claimed.

I responded to what is in the article.

You agree with me that patients can have blood drawn even without giving consent, unlike what this article says, attributing it to the nurse.
