Just to note, the unconscious person the officer was trying to obtain a sample from was a victim in a crash. He was hit head-on by a perp the police were chasing. Explains why there was neither a warrant, nor an arrest for the unconscious victim.
Sounds like the cop(s) know he/they did something illegal and they are trying to create the opportunity to cover their tracks, in a big way.
Most important point in this whole sad event. The cop was trying to make it the victim’s fault.
It also explains why the cop was so anxious to get something, ANYTHING, which would put the victim at fault. The patient, an innocent bystander, was injured as a result of the police chase. A lawsuit would logically have been forthcoming, and the cops would have been hit for endangering the public by their decision to perform the chase. The cops WANTED some drug offense to hang over the victim's head to blackmail him into not suing.
Sure, any case based on an illegal blood draw would be thrown out of CRIMINAL court, but the trucker would still face losing his commercial license and being fired and blackballed. The cops wanted blackmail leverage.
If that is true, then why IN THE WORLD would the Police Officer even THINK there was a need to take a blood sample from the INNOCENT VICTIM ? I think you have your STORY mixed up. The INNOCENT VICTIM is dead, not UNCONSCIOUS.
