Joe Arpaio saga isn't over: Judge to decide if his conviction stands

U.S. District Court Judge Susan Bolton canceled former Sheriff Joe Arpaio's upcoming sentencing hearing for his criminal contempt-of-court conviction, telling attorneys not to file replies to motions that were pending before his recent presidential pardon.

However, Bolton on Tuesday stopped short of throwing out the conviction based solely on Arpaio's request. Instead she ordered Arpaio and the U.S. Department of Justice, which is prosecuting the case, to file briefs on why she should or shouldn't grant Arpaio's request.

Bolton has scheduled oral arguments on the matter for Oct. 4, the day before Arpaio was supposed to be sentenced.

There is case law that says a pardon implies an admission of guilt, and that will have to be argued in open court.

It looks like Arpaio is trying to find out if his conviction would have been overturned regardless of the pardon.

I’m pretty sure Arpaio could just walk away.

So, the judge can be ignored. This is so silly. She is mocking herself, if that is the case.

As I understand it he was convicted and put in prison, right?

Arpaio can’t be trying to overturn the conviction. I’m not sure what this is all about.

It’s simply amazing how a Presidential pardon can be, ahem, trumped by a District Court Judge.

Black Robed Tyranny!

If I were Arpaio, I would pretty much just ignore anything they say or do at this point.

Sheriff Joe:

"Damn right I'm in contempt of you and your phony kangaroo-RAT court...Eff you and the jackass you rode in on.

Have a nice day ma'am."

He was not put in ‘prison’. He had not been sentenced. He faced maximum six months in jail.

Who cares what she does now? Trump overruled her, and she’s just flailing about.

So he probably has not been under incarceration in the meantime. OK, well, not sure you can pardon someone who has not yet been convicted. Maybe Trump jumped the gun on this one.

She needs to be prosecuted for judicial misconduct, violations of civil rights, etc.

Once again, people aren’t reading past the headline.

The Sherriff had already been found guilty. He was pardoned prior to the sentencing hearing. The Sherriff requested that the conviction be overturned. Since the Obama DOJ prosecuted the case, the Judge is asking the opinion of the DOJ.

What happened to this place. Every thread is filled with shills.

If they throw the conviction out, it is as if it never happened.

That has to be worth something to the guy.

Nixon was never even charged. Arpaio was convicted, then pardoned after a motion to overturn the conviction was filed.

Well, isn’t this interesting. Should the learned judge determine that pardon is an admission of guilt, I’ll expect immediate pardons of Bill and Hillary Clinton.

Nixon was not convicted and he was pardoned. The President can pardon the unconvicted as well as those crimes not yet revealed.

Yes, there are a lot of anti-Trump concern trolls here, pretending to be for Trump but Trumpeting every story that could be perceived as anti-Trump with their “not good” statements.
