It looks like Arpaio is trying to find out if his conviction would have been overturned regardless of the pardon.

I’m pretty sure Arpaio could just walk away.

As I understand it he was convicted and put in prison, right?

Arpaio can’t be trying to overturn the conviction. I’m not sure what this is all about.

He was not put in ‘prison’. He had not been sentenced. He faced maximum six months in jail.

So he probably has not been under incarceration in the meantime. OK, well, not sure you can pardon someone who has not yet been convicted. Maybe Trump jumped the gun on this one.

Once again, people aren’t reading past the headline.

The Sherriff had already been found guilty. He was pardoned prior to the sentencing hearing. The Sherriff requested that the conviction be overturned. Since the Obama DOJ prosecuted the case, the Judge is asking the opinion of the DOJ.

What happened to this place. Every thread is filled with shills.

Nixon was never even charged. Arpaio was convicted, then pardoned after a motion to overturn the conviction was filed.

Well, isn’t this interesting. Should the learned judge determine that pardon is an admission of guilt, I’ll expect immediate pardons of Bill and Hillary Clinton.

Nixon was not convicted and he was pardoned. The President can pardon the unconvicted as well as those crimes not yet revealed.
