Chattanooga is moving to renounce its position as a trustee of the Confederate Cemetery on East Third Street, according to a news release from Mayor Andy Berke's office.
"Our action today makes it clear that the City of Chattanooga condemns white supremacy in every way, shape and form," Berke said in the release.
"While we honor our dead, we do not honor the principle for which they fought. Our city should be invested in our future, not a discredited past. Confederates fought against America to preserve slavery. That is the truth, and we should no longer subsidize any myths to the contrary."
The release states the city is not on the deed for the land, but Berke also has asked City Attorney Wade Hinton to file paperwork to confirm Chattanooga is the city is no longer listed as one of the cemetery trustees.
Hinton said the city has allowed the Sons of Confederate Veterans to make repairs to the cemetery under the assumption the city owned the property. A review of records showed "this does not appear to be the case," Hinton said.
"There is no reason why we should have any responsibility for maintaining the Confederate Cemetery a property we do not actually own."
The release said the terms of the cemetery trust have expired. It said the city will ask Hamilton County Chancery Court for a ruling on its status as a trustee and to determine who owns and must maintain the property.

May 29, 2003 [S. 330] To further the protection and recognition of veterans memorials, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the Veterans Memorial Preservation and Recognition Act of 2003.
SEC. 2. CRIMINAL PENALTIES FOR DESTRUCTION OF VETERANS MEMORIALS. (a) IN GENERAL.Chapter 65 of title 18, United States Code, is amended by adding at the end the following:
§ 1369. Destruction of veterans memorials (a) Whoever, in a circumstance described in subsection (b), willfully injures or destroys, or attempts to injure or destroy, any structure, plaque, statue, or other monument on public property commemorating the service of any person or persons in the armed forces of the United States shall be fined under this title, imprisoned not more than 10 years, or both.
(b) A circumstance described in this subsection is that (1) in committing the offense described in subsection (a), the defendant travels or causes another to travel in interstate or foreign commerce, or uses the mail or an instrumentality of interstate or foreign commerce; or (2) the structure, plaque, statue, or other monument described in subsection (a) is located on property owned by, or under the jurisdiction of, the Federal Government.

Most Southerners fought because the Yankees were invading their states, their cities and towns and creating mayhem in the process.
I remember reading an old anecdote about a Confederate enlisted man who was captured in Virginia.
The Confederate soldier was sitting on the ground under guard when a Union officer walked up to him and asked the Confederate soldier why he was fighting.
The young Southern soldier raised his head and looked at the Union officer as though the Yankee had two heads.
The Confederate soldier looked the Union officer squarely in the eye and answered, “Because you’re HERE!”
If I remember right, that Cemetery was mostly fed from the large Union hospital treating enemy wounded. It was kind of run down and not well maintained.
I got a much “sadder” vibe there than I did at the Military cemetery up the street.
There are several “Negro US Soldiers” buried there as well.

The cemetery is not at National Cemetery. It’s a little Cemetery that sits next to a public one. It looks pretty shabby already.
My old boss, a Certified Investment Planner, not a flake or anything, said she couldn’t get out of her car at Gettysburg one day because “there were too many dead soldiers.” Sometimes the past is really present, like when the clouds are covering Lookout Mountain, just like it was described by the survivors of the “Battle in the Clouds.”
