Family sues UCSF following death of cancer patient

In one of the first legal actions involving California’s “right to die” law, the family of a deceased cancer patient is suing UCSF Medical Center, alleging the system did not appropriately aid the woman in ending her life.

The San Francisco Superior Court suit, filed by attorneys for the family of Judy Dale on July 7, claims that Dale’s caretakers at the hospital told her they would assist her in obtaining medication to help her die — but then suddenly backtracked.

Dale succumbed to her terminal cancer in September 2016, according to the lawsuit. She did so without the medication that would have killed her on her own terms, the suit says. Latest news videos

California’s End of Life Option Act went into effect in June 2016, a landmark and controversial piece of legislation that allows terminally ill adults to obtain medication to end their life if certain conditions are met. Among them: The patient must make two oral requests to a doctor that are spaced at least 15 days apart, as well as a written request.

Doctors are not legally obligated to participate in the procedure. In a statement, UCSF did not comment specifically on the lawsuit, citing the pending litigation.

The hospital said it was one of the first in the state to develop a protocol for complying with the state law, adding that it “respects” the right of its physicians to opt out at their discretion.

The right of its physicians to opt out at their discretion will eventually be eliminated, and to speak against it will be considered hate speech.

This is a big deal in the Bay Area. UCSF is one of our best Hospitals. They have an excellent team of cancer doctors, or did have last time I had to bring a client there for treatment. Many of the finest surgeons see the approach or likelihood of death as a challenge, an affront to their professionalism.

It’s going to take an awful lot of mental recalibrating for doctors like these to become willing ushers down those one-way corridors that lead a patient to death. For some of them, it’s like forfeiting a big game. They won’t do it unless forced to.

I can imagine that hospitals will end up having one or two doctors on staff that specialize in assisting suicide.

Like Kevorkian they will be a little insane. Or doctors who just don’t want to do medicine. Maybe incompetents.

It will be the raghead docs that will do it just help “thin the infedle herd”.

Then it will migrate to other Patients then the raghead doc will claim the charts got mixed or some crap like that...

yes, it does sound like greed. My father is on hospice right now. He will die at home most likely this summer. He has no pain but hospice gave us all the medications we will need should that problem arise.

Thank you so much! I have to tell you, it is just so, so hard to watch my poor father decline. We love him so much. But I know he is tired of being sick and will soon be with God. Watching him walk through that door is the hard part. I’m pleased with hospice so far and the care he has gotten.
