Does anyone know if trump can take this back to the SC and get a quick ruling on it?
The regular process would have this decision appealed to the 9th Circuit. But, because the most recent decision is an interpretation of an order of the Supreme Court, it would be reasonable to bypass the usual process and appeal directly to the court that issued the order in the first place, the Supreme Court.
In this instance, the Supreme Court can't claim that the defendant has to get his appeal heard by the Circuit Court of Appeals, while SCOTUS is able to decline to head the results of that - no matter what, SCOTUS will hear the results of the appeal, and the District Court ruling is on a SCOTUS order, not on a 9th Circuit order.
The Hawaii judge in essence told SCOTUS to go screw themselves and seems to have forgotten he is overruled.
