Democrats Seek To Declare Trump ‘Incapacitated’ And Remove Him From Office

Twenty-four House Democrats are now backing the bill.

A Democratic congressman has introduced legislation aimed at creating a congressional oversight commission that could declare President Donald Trump incapacitated, prompting his removal from office under the 25th Amendment of the United States Constitution.

Twenty-four House Democrats support the bill, which was introduced by Rep. Jamie Raskin, D. Md., including the ranking member of the House Judiciary Committee, Rep. John Conyers, D-Mich.

Former chairwoman of the Democratic National Committee, Rep. Debbie Wasserman Schultz, D-Fla.,has co-sponsored the bill.

There are a huge number of Democrat members of Congress and the Senate who have demonstrated they have the mental capabilities of a squirrel. Declare those democrats incapacitated first, because they're stark raving lunatics.

Maxine Waters, Nancy Pelosi, Barbara Lee and Jackie Speier for a start, and that's just California female members. They are crazy people who need to be removed from office.

There was one statement made by Hillary during the campaign that was correct and currently applicable: “Those who will not accept the results of a presidential election are a threat to our democracy!”

President Trump should tweet this every day until the nonsense stops.

This latest move stems from their unwillingness to reconcile to the fact they lost the election last year fair and square.

Removing Trump from office won’t cure what’s killing them.

They need to keep up their Hate Trump because Americans have voted against Trump four times, right?

I missed the part where the Democrats won.

They are doing this to keep their hardcore Hate Trump base from melting down.

Their legislation isn’t aimed at moderate swing voters.

Yeah, there’s a winning message for the 2018 midterm elections.

Its only summer and they’re trying to hit low-hanging fruit instead of going higher.

They have no message and no alternative policies.

First off, the 25th Amendment can not remove anybody from office. It is not an alternative to the impeachment process. It clarifies when the VP becomes President and when he becomes Acting President; the latter meaning he temporarily fills in for the President without succeeding to the office. When a VP has been an Acting President (has happened three times), no succession occurred and the President regained his powers.

As for this proposal, it is permissible under Section 4 of the 25th Amendment. The Cabinet may be replaced with "such other body as Congress may by law provide". However, this proposal is nakedly political. The sponsors of this bill expect this commission to immediately declare the President disabled. This would then put pressure on VP Pence to agree.

Even if amazingly they succeeded is having Pence become Acting President, Trump could then declare himself fit for command. Pence and the commission would then have to challenge this declaration for Pence to remain Acting President. Congress would then have to decide the issue (see second paragraph of Section 4 of the 25th Amendment for details). No way would two-thirds of each House of Congress side with Pence and the commission. This would result in Trump regaining the Presidential powers.

Note again: at no time would any of this result in Trump being removed from office. The supporters of this bill are not only desperate to remove President Trump from office, they are too stupid to know which part of the Constitution deals with such removal.
