A group of 10 Republican state attorneys general and one governor are threatening to sue the Trump administration if it does not rescind Deferred Action for Childhood Arrivals (DACA), the Obama executive action that granted amnesty to more than one million undocumented immigrants.
We respectfully request that the Secretary of Homeland Security phase out the DACA program, Texas Attorney General Ken Paxton wrote in a letter to Attorney General Jeff Sessions on Thursday.
The letter was signed by nine other attorneys general, as well as Idaho Gov. Butch Otter.
In the letter, the Republicans called on the Trump administration to rescind DACA, which Obama enacted through executive action on June 15, 2012, and to order the Executive Branch to cease issuing and renewing DACA permits in the future.
Earlier this month, Sec. of Homeland Security John Kelly rescinded Obama executive actions implemented in Nov. 2014 that expanded DACA and created a new amnesty initiative, Deferred Action for Parents of Americans and Legal Permanent Residents, or DAPA.
But in that memo, dated June 15, Kelly stated that Obamas original DACA initiative will remain in effect.
Under DACA, more than one million undocumented immigrants brought to the U.S. illegally as children are eligible for protection from deportation and work permits.
Paxton asserted that if DAPA and Expanded DACA are unlawful, as the Trump administration maintains, then Obamas original DACA policy is as well.
In the letter, Paxton said that his fellow state attorneys general will voluntarily dismiss a pending lawsuit against the federal government over its amnesty policies if the Trump administration agrees to rescind DACA by Sept. 5.
Otherwise, the attorneys general will modify the lawsuit to include a challenge of DACA.
The complaint in that case will be amended to challenge both the DACA program and the remaining Expanded DACA permits, the letter states.
While Trump and Sessions have taken a hard line on illegal immigration, the administration has avoided addressing DACA, much to the chagrin of Trumps base and in violation of the real estate barons campaign promises.
We will immediately terminate President Obamas two illegal executive amnesties, in which he defied federal law and the Constitution to give amnesty to approximately 5 million illegal immigrants, Trump said during the campaign.
Some immigration hardliners have predicted that a lawsuit against DACA may be the only thing that forces Trump to roll back the Obama executive order.

DACA has no basis in law and is just as illegal and unconstitutional today as when it was called that by candidate Trump in August of 2016.
Beyond time for this affront to the rule of law to be ended.
"Sue and settle" was an often used tactic of the Obama administration. The DOJ would be instructed to roll over and settle in a way which achieved the effect of law or regulation without legislation.

This is quite a bit different than the way Obama used it, where he’d sue, say, Texaco for a billion dollars or so because one of their oil workers gave a mean expression to Snail Darter.
But the Obama would ‘settle’ with Texaco for $50 million, providing that Texaco sent that money directly to the Sierra Club.
It was about as ILLEGAL as you could get and people should go to jail for it...and perhaps they will.
This is quite a bit different. First it’s not clear whether Trump even wants the suit, and second, no money will change hands. But the country will certainly win if the AGs prevail, and so will Trump, in a way. Trump will have cover to get rid of the Dreamers and shut that program down, and the country will continue on its very long path to law and order.

What you say is true, but I think you only hit one side of Obama/Holder’s misuse of the courts. You were talking about the corporate shakedown used to fund pet left and Muslim causes. True enough.
But, another one method was where a suit was brought alleging some problem—pollution, gender or racial insensitivity, or perhaps labor law. Normally, the government would defend itself from such a suit. But, if the suit agreed with the government’s agenda, the DOJ wouldn’t defend vigorously. They would either throw the case, or agree easily to a settlement rubber-stamped by a sympathetic judge, giving the plaintiff what they wanted... and what the government wanted. I remember reading of a few of these involving labor and the NLRB
It wouldn’t surprise me if there was collusion at the outset of these suits, either. Call me paranoid if you must.

Not that I expected much of anything from D.C., or much from the States for that matter, but it’s a bit harder to find those scattered to the wind years later.

IMO, worst possible ‘solution’. I’d expected a more ‘the buck stops HERE’\BOSS-ly man; not one hiding behind the law. Many, I’d think, would re-think that image, if not trust\hope, in the man.
Still, glad they’re FINALLY getting the show on the road
Who knows, Pres. Trump, himself, might have signaled these AGs to begin the process. Far better for the states to carry a pail than for him to continue to ban or defer, deport any additional undocumented, illegal residents. His promise to the American people, was DACA will be something everyone will like. At the time, no one could see that would ever happen. With the individual states involved (with current DACA residents)perhaps a way has been found to at last bring this ugly unconstitutional chapter to a close.

Ken Paxton, Texas is mighty proud of you, sir. We love to see you taking it to the “sanctuary cities”. If not stopped now, we’ve lost our state and ‘they’ have absconded with bucket loads of taxpayer’s hard earned greenbacks.
