It sounds like she can meetthe actual malice standard, which is hard to do because normally the media toes the line but doesn’t cross it like they apparently did here.

“Actual malice in United States law is a condition required to establish libel against public officials or public figures and is defined as “knowledge that the information was false” or that it was published “with reckless disregard of whether it was false or not.””

If the trial is held in Manhattan she doesn't have a prayer.Johnnie Cochrane knew his client was guilty and also knew that his only chance was for the trial to be held in da hood.He succeeded in getting it moved from where it should have been held.

I’m obviously not a lawyer, but don’t you have to prove you’ve been damaged? I suspect the NYT can easily produce a thousand surveys of thousands of people who already believe Sarah Palin is a dangerous, hateful, idiot. This article hasn’t changed their beliefs one bit. Conversely, anyone who knows Sarah hasn’t had their beliefs changed either. So really... with which people has she been damaged?
