"Actual malice" in 1st amendment law is a legal term of art that has nothing to do with malice.

"Actual malice" exists on a finding that the publisher knew the statement was false.

The report was an editorial. As such it is given much more weight than an article written with a byline. It expresses the policy of the paper itself. Thus, she has a perfect opportunity to sue, if she chooses.
