I’d have to know the full terms of that probation, because it sounds like the judge made some strong statements and then went soft on the guy.
But he still suspended his sentence...
Some me just need beating.
Or is it shooting they need? Or both.
I wondered about that, too, but figured it was probably one of those “deals.”
Clay Allison - Wikipedia
https://en.wikipedia.org/wiki/Clay_Allison
Robert Clay Allison (September 2, 1841 July 3, 1887) was a cattle rancher, cattle broker, and sometimes gunfighter of the American Old West.
He fought for the Confederacy in the Civil War.
Allison had a reputation for violence, having survived several one-on-one knife and gunfights (some with lawmen) ... known as the man who “...never killed a man that did not need killing.
Justice would be to make the judge serve the 15 years sentence when the criminal goes feral again.
” I would have shot you but I’ll give you probation instead.”
“You have been tried by twelve good men and true, not of your peers but as high above you as heaven is of hell, and they have said you are guilty.”
Judge Roy Bean
“Retained jurisdiction”
Does that mean he’s off the street, but not in an official prison while he gets his fecal matter together?
Seems like there ought to be a clause in the law which allows the judge to let the defendant decide between:
A) 15 years in prison
or
B) letting the victim work him over with a baseball bat for up to 15 minutes where every minute until he yells “UNCLE” reduces his prison time by a year.
Definitely a way with words!
Maybe they’ve come up with something like “Learner Prisons” or “Prisonettes.”
Crimergarten?
If the guy gets 15 years probation, and has to jump through hoops for all that time, there may be some merit to it.
I just think of the guy getting whacked with the bat and wonder what mercy he received?
I’m really sick and tired of seeing people who do violent or sexual things to kids who continue get breaks.
Some things you just don’t allow to take place. Period.
Throw the dang book at them and be done with it.
My bet is a better margin and very limited risk.
In southern Idaho that was a citizens arrest when I was there.
Take out the uncle part of it, and you may be on to something.
To be honest, I wouldn’t want to work anyone over with a ball bat.
Now if he had done something to my wife or my child, all bets are off. I could find the motivation in that. Heaven have mercy on the guy then.
I suspect the guy isn’t sorry for what he did. (of course I have no way of knowing / I may be wrong about that)
I suspect he thinks the only bad thing he did was get caught. If that’s the case or even a chance of the case, I’d be hard pressed to give him a single break.
Also, how many events like this did he participate in before he was caught doing it for the first time?
“Stand up, Alferd Packer, you voracious, man-eating s— of a b——. There were seven Democrats in Hinsdale County, and you ate five of them.”
That would be funny if the judge then pulled out a .38 snubnose from under his robes and commenced firing.
