The issue here is that a disproportionally large percentage of the more at risk gay community are infected with HIV and wish to supplement their incomes by selling their blood and body fluids. The selling of blood, blood plasma and body fluids is common form of income supplementation among lower income residents.

Senator Wiener is not trying to enable altruistic donations, wants to enable the ability of HIV positive people to freely engage in the commercial selling of their blood int the American blood supply without any restrictions.

Since donating blood and body fluid products is increasingly a for profit commercial activity for private individuals to supplement their incomes, it actually needs more scrutiny and regulation than it currently does and the knowing sale of contaminated blood needs to have more, not less, serious criminal penalties.

Don’t “medical devices” get regulated by them?

How could blood and semen be exempted for oversight?
