The decision whether to prosecute or not is lodged in the DOJ not the FBI. Comey either misspoke or exceeded his authority.
It’s the FBI s job to turn it over to the DOJ for actions. Think motive the police who turn it over to DA for prosecution. (That’s why we need a strong FBI director ). Regardless congress has no power.
