The only way they could do that is to steal your brother’s password and use his mailing list.

Or, if your brother already changed his password after the hack, they have created an email account that reads almost exactly like your brother’s real email address to trick you.

No - e-mail headers can be hacked also. So it can appear that the e-mail came from his brother but it didn’t.
