“The evidence will show that these defendants took a gun into a volatile protest in Red Square, and that Marc Hokoana engaged in several provocative acts, including using pepper spray on the crowd,”

This leads to several questions:

1. In what sense was the protest "volatile"? Was it because the protestors were engaging in violent acts?

2. Why did Mr. Hokoana use pepper spray? What was he responding to? the beating of someone (which I saw with my own eyes)? or being surrounded by a screaming mob, shouting obscenities?

3. I saw protestors beating up at least one person? ere they arrested? If not, why not?

4. Have you ever used pre-protest comments in the prosecution of a protestor?

5. Was the protest in itself "provocative," which you use as an argument against the defendant? Why is some "provocation" criminal, but not other provocation?
