The folks staying there are not illegal as they are on the Mexican side of the border. They become illegal when they cross the border.

Depends on whether they are Mexican nationals or Hondurans, or Nicaraguans, etc. All except Mexican nationals are illegals in Mexico at the time unless there under permit.
