All Waco Trials Delayed

As recently as this morning it seemed impossible, but the Twin Peaks legal fiasco got even more ridiculous this afternoon.

McLennan County, Texas District Attorney Abelino Reyna, who is gratuitously prosecuting 192 people who were at the Twin Peaks restaurant in Waco on May 17, 2015, filed a ridiculous “disclosure” in the 19th Judicial District today, “in the spirit of Brady, the Texas Code of Criminal Procedure 39.14 (the Michael Morton Act), our ethical obligations under Texas Disciplinary Rules of Professional Conduct, and our duty to ‘see that justice is done.’ The document is titled “State’s Disclosure of the Existence of Federal Evidence Not in its Possession or Control.”

Disclose This

The disclosure begins: “On March 28, 2017, the McLennan County Criminal District Attorney’s Office received a letter from the United States Attorney for the Western District of Texas, Richard L. Durbin, Jr. This letter provides the broad outlines of an investigation into the Bandidos Outlaw Motorcycle Club, United States v. John Portillo, et al., Cause No. SA-15-CR-820 (see attached). In the letter, Mr. Durbin declines to share any information or evidence relating to that investigation at this time. Mr. Durbin has indicated that the information will be disclosed to the McLennan County Criminal District Attorney’s Office once the trial is complete.

“Although no specific disclosures were made, Mr. Durbin acknowledges that the federal investigation has information which relates to the events at Twin Peaks in Waco, Texas on May 17, 2015. Although the federal investigation was underway when that incident occurred, neither the fact of the investigation nor any information pertaining to the investigation were shared with this office.”

The “disclosure” continues:

“Despite repeated efforts to obtain this information, our office has no specific knowledge of the contents of the federal investigation. The information is subject to a protective order and not in our control, preventing our actual or imputed knowledge of the specific information. Tex. Rules Prof. Conduct 3.09; Rubalcado v. State, 424 S.W.3d 460 (Tex. Crim. App. 2014). The federal investigation has been ndependent of this prosecution, and no collaboration between the offices has occurred. This information may be exculpatory, mitigating, or impeachment evidence as contemplated by Brady v. Maryland, 373 U.S. 83 (1963).”

Tarradiddle

Reyna has been lip synching the same song for more than a year and a half. The disclosure is tarradiddle. The Waco bloodbath was the result of a federal investigation into the Bandidos Motorcycle Club. That was where Patrick Swanton got his “intelligence.” And anybody who has ever looked at multiple federal investigations of motorcycle clubs knows they all employ the same game plan. Federal investigators or deputies drawn from state and local police forces infiltrate and try to ingratiate themselves to the target club. The infiltrators act as agents provocateur, buying guns and drugs at well above market price, asking to store cigarettes in a club brother’s garage, offering large sums to out-of-work men for a few hours of “security” and encouraging violence.

Waco has always been reminiscent of the murder of a Mongol named Manual Vincent “Hitman” Martin on the Glendale Freeway in the middle of the night in 2008. Undercover agents with the Bureau of Alcohol, Tobacco, Firearms and Explosives had foreknowledge – if they did not kill him themselves – that Martin was going to be murdered. The undercover agents, whose names were Gregory Giaoni, Paul D’Angelo and Darrin Kozlowski, not only allowed the murder to occur but they incited it by picking on the wrong, bad dude in a bar. The next day Kozlowski used the murder as an opportunity to try to incite Mongols leaders to go to war. Something like that self-evidently happened at the Twin Peaks.

What’s Really Just Happened

Reyna has just plausibly denied that he ever knew anything about the federal Bandidos investigation, or its connection to the Twin Peaks. He did not arrest 177 people on the spot because he wanted to shut up all the witnesses to the brawl until the migrating press moved on. He arrested them all because it was his “duty.” Now he and his duty are hiding behind the federal case. And why, exactly 14 months after the Bandidos indictment was unsealed, should anything about the investigation that preceded it remain secret?

But what happened today is not merely about Reyna covering himself. Today’s “disclosure” was strategic. Reyna’s proclamation that there is evidence that might prove the people he has been persecuting for the last two years are innocent is almost as offensive as his statement that he made today’s filing because he is duty bound to “see that justice is done.” Everything Reyna says sticks to your boots and stinks.

What Reyna has been doing for the last two years – beside stalling – is trying to find a case he can win, with a poisoned jury, in Waco. Earlier this month there were five, scheduled Twin Peaks trials. Who Reyna really wanted to try, according to multiple sources, was a Bandido named Jake Carrizal. Reyna thought he could get a Waco jury to believe that Carrizal started the whole mess by running over a Cossack prospect’s foot. That did not happen but the accusations against the 192 defendants in the case have never had anything to do with consensual reality. It is at least possible that Reyna would have tried to convince a jury of his homeboys that Carrizal, not the Texas Rangers, erected the polecam just outside the Twin Peaks patio where the fight started. The way these things usually go, Reyna would have accused Carrizal of putting up the polecam because he wanted a “trophy video.”

But that’s not going to happen now. Carrizal’s trial was continued last Friday and it will be continued again because Reyna just learned yesterday that the feds might be holding evidence pertinent to all the Twin Peaks cases. Just yesterday.

Just Yesterday

So it is now Reyna’s “duty” to make sure nobody goes to trial until all the evidence can be disclosed. And that can’t happen until after the trials of former Bandidos President Jeff Pike and former Bandidos Vice-President John Portillo, and four more defendants who were just appended to the Bandidos indictment, are complete.

There have been three indictments in the Bandidos RICO case so far. Who can guess how many superseding indictments there will be this year? Next year? The year after that? And all of them so secret that no one who is a mere citizen is allowed to know anything more about the Bandidos case than the accusations.

Undoubtedly, some defense attorneys in the Waco case will want to take their clients to trial before the federal case finds its putative conclusion. But Reyna, and the feds, will never allow that to happen. Reyna has his “duty” you know.

Wish you could serve a 20 year prison term though. Convicted on false charges, and tried under dubious conditions, where the testimony of persons who were being threatened with life imprisonment (if they didn't make whatever they had to make up sound good enough to secure your own conviction & imprisonment) was what sent you away. That would serve you about right. Good enough for others === good enough for you.

Meanwhile, Paul Looney, who is, as you put it, so I can copy/past it here; "an experienced CRIMINAL DEFENSE ATTORNEY". He said to Renya -- bring it on. Let's get it over with. Somehow other defendants were slated for trial instead, and that's coming more than a year after Looney said let's see what ya' got, let's put this novel theory (Renya's prosecutorial theory) to the test.

Four, possibly five of those shot dead possibly had been shot by police. Two of them quite possible shot by police only. The police were expecting trouble, and did themselves arrive well armed. They set up a pole camera to help video the action. It's a bit like they wanted it to happen, although to be fair, I think the set-up aspect, the having ginned up a biker war was on the part of the Feds, not the Waco local yokels. Compared to manipulations from within the MC's on part of the Feds (using undercover agents) the Waco PD do look like choirboys in comparison.

Of the 18 wounded -- how many were shot with 5.56x45, or .223 Remington near-equivalent?

Then for crying out loud, arrest and put to trial persons under those charges, who are guilty of that.

Just don't come telling me that Renya's way of insinuating they were all guilty of being criminals (because they had biker paraphernalia on their persons) equals they were all there as part of a conspiracy to commit murder(s). That's BS, and you, and Renya both are FULL OF that.

The real bottom line between you and I, is that every weapon you've tried to form against me has failed. Most of your legal argument has either failed, or been shown to only, and to best work whenever there is a normal for McClennan County way of doing business that is not "law" as that is known, in most of the rest of the State of Texas.

"When you combine an extreme level of talent with an extreme level of moral crusade, you can get dangerous outcome, and that is what happened here," English's Houston lawyer, Paul Looney, said of the assistant district attorney spearheading the prosecutions.

Looney said that he's never seen anything like the way the wheels of justice turn here.

"I am spending all of my hours shopping bookstore to bookstore for the Book of Waco," Looney said, "because the criminal procedures being followed in Waco are not in any of the $400,000 worth of books I have in my law library."

It's more like I don't want bad legal precedent(s) to be further enlarged & enforced. That is all.

I'm an American. A Christian. An individual the Lord has spoken directly to, many times. Twice, two late-mornings in a row, He told me in His smallest voice --"you are free". So quiet His voice on those occasions --I almost missed it-- but I know the sound of that voice.

When hearing it the first time, I was puzzled, yet encouraged too. Hearing it again the very next day, when I lay foot-fall on quite possible the very same boards (same exact planks of a wharf on the West Coast) it stuck me. He can swear by none other than Himself. He does confirm His own words to us.

That was approximately 20 years ago by now. I'm still free.

I'm not even going to waste my time clicking on a youtube link that bears no labeling of what it is. Some bad thing you desire to happen to "bikers"? Careful what you wish for, amigo. You may not have the standing to be above the curses casually flung around. They can have a way of turning 'round and biting back. That's one of those "kids -- don't try this at home" kind of things...

Conspiracy to commit assault, and murder? You capitalized the word ALL. I used to do that when talking about this issue on this forum, prior to yourself having signed up.

The problem is they are not ALL guilty of being part of conspiracy to commit crime, in Waco, in the parking area of the now-closed Twin Peaks restaurant. It would be impossible, unless there was some word distributed --- that Renya knew about (but has still not yet disclosed -- that; that would be time and place to LAUNCH attacks).

DEFENDING oneself, and ones associates from assault is yet again an entirely different matter, including being aware of the possibility the possibility some az-hole might do something stupid and start a fight. The local Cossacks chapter president, according to anecdotal information published in the newspapers, was repeatedly encouraged to attend the event --- by a Waco PD officer who was hoping to convince that Cossacks MC chapter president to try to 'work out a peace' between the two MC's.

Widening th scope of things to take into considertion another case, a "Federal" case I take it ---Who influenced Portillo to allegedly "declare war" against the Cossacks MC? That latter club did not bill themselves as 1%'ers. Nor were they on LE agencies lists of "outlaw" MC's prior to having a few of their members criminally assaulted by members of Bandidos MC.

There goes the ALL assertion -- right out the window?p>

How many times need I explain it. How many bites of the apple do you think you deserve, and are owed?

Bottom line, despite what all you LEO and government hating people claim, these motorcycle scum murders and drug dealers and many who came with them with the foreknowledge such crimes were likely to occur are going away for a LONG time.

By the way, you claim they are not ALL guilty. ALL, except those who roll over (and there will be many) will have their chance to establish their innocence before a jury. You do support the Constitutionally-mandated jury system, do you not?

Regarding the “evidence” in the newspaper, how would you go about cross-examining “an anecdote in a newspaper column?” I know, a tough question! A Vulcan Mind Meld with the newsprint, perhaps?

And remember, when it’s all over, they are going to do TEXAS TIME, now in part thanks to people like you who are painting targets on their backs.

I also wonder where the noOb liar is really from (more importantly, now at) and if a forum moderator would check to see if the isp addresses just so happen to match with another Waco thread troll.

If interested, a moderator could (should possibly, if interested) also make inquiry of yet another freeper who has posted to this thread regarding who he thought may be a match. That was less than entirely clear to me.

Which brings to mind; how many freepers over the years have been 'gubmint agents? We sure had some rooskie-trolls come flooding in back during Euromaidan, with that increasing in the aftermath, and right about up to the Crimean break-away [cough-cough] voting.

Now watch somebody come trippin' along accusing me of being a Soros plant. What the hell? Why not? According to a couple of lying idiots on this thread -- I want murdering drug dealers to go free. May as well go for broke.

I think I may have initially misunderstood what you meant when you said "on-site". I was thinking -- undercover agents within MC's and on-site in Waco that fateful day in May. If you were intending to mean on-site of FR, please forgive my being slow on the take-up. Duh. Ice cream cone to the forehead moment for me, maybe.

Ignore the idiots.

They are all a bunch of foolish jailhouse lawyers and LEO haters.

Foe example, they do not even understand that the delay which triggered this post was legally required and benefited the defense.

When this gets close to trial, there will be plenty of witnesses, from the Banditos and Cossacks themselves, who will testify about what happened, all the premeditation of other felonies, and everything else leading up to the shooting, in exchange for lighter sentences.

Best guess, out of these murders, 4 to 7 LWOP or death sentences, at least a dozen or so 3-5 (all hard TEXAS TIME) and a whole bunch of 180 days in County.

The fine people of the Lone Star State are not happy with these scum and they will show their discontent in their verdicts.

BTW, a TS reality: If anyone tries to be a jury holdout, in anything other than the death penalty decision, can you imagine what their life would be like in Waco, or wherever they move the trial for a COV.

PS, my best guess for a COV? Amarillo - Potter County in the Panhandle.
