The two cases are not at all similarly situated.

Different laws, different states.

Moreover, the case in New York is a bar and bars can refuse people for dress code.

Most importantly, a bar employee can throw anyone out who they perceive to be intoxicated.

End of story.

I’ve never heard of bars refusing people on dress codes. Then again ‘round these parts. Know what I mean? Think it would have been a better idea to ask the man to take off his hat. In fact, in the old days men took their hats off when they went into buildings.
