Congress passes laws, judges interpret laws constitutionally.
If a judge overturns a law congress can pass modified legislation that corrects the grounds for the judge's decision.
Last time they made it nationwide (not sure why that was allowed)
So, if we take that as fact, the current Republican led Congress can modify the ACA to specifically state that it is a (an unconstitutional) mandate and not to be considered as a tax?
The implications are mind boggling!
And yet they don’t overturn laws that clearly infringe the 2nd Amendment.
It seems to me that they only defend the Constitution when it suits the leftist agenda.
I guess we can't say the Courts are unprincipled, because that seems to be about the one principle the Courts seem to respect.
Yes, if they have the balls to do it. They can also rescind it entirely as an unconstitutional mandate rendering it a moot point legally.
