That’s a little confusing- It seems liek you are saying that the EPA are under no obligation legally to comply with his order?
What I meant is that under the doctrine of “ultra vires,” any action taken by an agency without authority to do so is void. In other words, if President Trump signs an executive order stripping a particular arm of the EPA from engaging in a specific activity, the people in that agency are no longer legally authorized to engage in the activity. Any attempt they make to do so is considered null and void for lack of authority.
The original comment I replied to indicated that the EPA employees would be slow to implement Trump’s policies. Since his policies are to cease and desist their current activities, it’s not like they can delay doing what they want, it’s that they no longer have the authority to do what they want. Any attempts to pursue policies they’ve been told to stop are invalid.
