There is no federal law that requires any educational institution to refrain from discriminating on the basis of sexual orientation. There are only federal laws that require institutions to refrain from discriminating on the basis of sex.
Like it or not, that is a fact. The Obama administration decided that it would be a good thing if schools that receive federal funding accommodated transgendered students by permitting them to use bathrooms and locker-rooms that aligned with their own subjective sexual orientation. Having made that decision, there were two ways the Obama administration could have proceeded to achieve that goal.
One way would have been to candidly announce that the current legal framework did not permit the federal government to impose such a requirement on schools.
It then would have been appropriate for then-President Barack Obama to argue in favor of federal legislation that would have required educational institutions receiving federal funding to accommodate transgender students.
A second way to proceed would be to pretend that the administration had power it actually did not have under the law.
The Obama administration chose the second way: it pretended that statutes that prohibit discrimination based on sex were equivalent to (non-existent) statutes that would prohibit discrimination based on sexual orientation. . .

Does what is legal actually matter? It’s headed to the SC. I think it will be a miracle if States will be “allowed” to be keep boys and young men out of girls bathrooms,locker rooms and showers. Insanity.
A little off topic, I was at the VA today and there was a lib there thinking he could terrorize the people in the waiting room. He was yelling that Trump’s trips to Mar A Lago were more expensive than all of Obama’s entire first year vacations. Another woman there let him know that was fake news and I agreed with her. I also said “Besides, Trump actually does work when he’s there.” The guy disagreed.
I told him Trump has done more in 30 days than Obama has done in 8 years. He said Trump hasn’t done anything and wanted to know what I believed Trump had done. I told him in 30 days Trump has reversed the Executive Orders Obama spent 8 years inflicting on us. He said, “But what has Trump done for anybody.” I said, “Well, now I can go to the bathroom without worrying about any man coming in there.” He couldn’t change the subject faster.
Hee hee.
Last April, a federal appeals court ruled in favor of Grimm, who fought a school board policy that denied him access to the boys' bathroom but allowed him the use of recently constructed single-stall unisex restrooms.
In siding with Grimm and against the school district, the court deferred to the Obama administration's interpretation of Title IX.
The court relied on an executive order which has been revoked therefore the SC will likely kick it back down for review.

When I saw a news clip of Trump meeting with dozens of the top CEO’s in the U.S. it struck me that he is doing more in a few hours than Obama did in eight year.
