“The appointment of judges is typically a three-legged stool,” Mr. Malcolm said. Guidance comes from the home state senators, the White House counsel’s office and someone from the Department of Justice, typically from within the Office of Legal Policy. “How the power balance shifts among these three points varies somewhat from administration to administration.”

Obama appointed 40% of today's federal judges. It would be good for balance to be restored by President Trump's Administration appointing the same amount.

The courts are more of a problem than congress is. I wish Trump could also remove Obama’s judges.

Trump needs to appoint conservative activist judges willing to legislate from the bench when necessary.

It’s nuts for us to play by the Marquess of Queensberry rules when we’re up against M16 and Chicago Gang members armed with guns and broken bottles. If their judges rule from the bench ours (our side) must too.

So you’re only opposed to activist judges when they don’t agree with you? You should not condemn a group of people (liberal activist judges) and then turn around and encourage the exact same behavior in like-minded people, IMO.

Chuck Grassley, the chairman of that committee, has said that he will continue to honor the Senate tradition of the “blue slip” policy, effectively giving senators veto power over judges nominated to serve the districts in their state.

And this is why nothing will change. trump will never, ever get a conservative on the bench in CA, OR. or WA. Liberals will continue to dominate the judiciary until Senate Republicans grow a pair and at this point I'm convinced that's a biological impossibility.

Say what? Legislating from the bench has about destroyed us - either you believe in the Constitution (which has no “noble cause” clause)or you don’t - decide.

There are 118 vacant seats right now with only 1 nominee. Trump needs to start appointing like crazy and McConnell needs to jam them all through on simple majority votes.

Further note: The GOP will be defending just eight Senate seats in 2018, while Democrats must fight for 23 — plus another two held by independents who caucus with the Democrats.

THEY - liberal elites - legislate from the bench... it's how liberal elites have changed the culture in record time. They don't get their ideas in place by changing laws - they ‘win’ by cheating.

Every State where gay marriage was voted on it lost. EVERY TIME. So what do ‘elites’ do? They get a ‘judge’ to rule - one of THEIR judges - and it becomes law.

I would rather both sides play by the rules set up in the Constitution but if that's NOT possible then we need to play by the rules they've made for themselves.Obama put the most extreme liberal judges on the bench he could find. We need to do the same.

I’m opposed to activist judges if both sides are wiling to follow the same rules.

I’m not in favor of one team being kneecapped while the other team gets to use machine guns.

Think Robarts is teaching President Trump a lesson. Activist judges are ruling America and it will not stop. We either learn how to street fight garbage or we lose more than we gain. The 9th Circus needs to be broken up and conservative Constitutional Judges need to fill both Courts. (Named 9th and 12th)

Rebuild the 9th and make sure the 12th is our Constitutional right leaning judges.

Draw the lines just so, and the Sagebrush Rebellion could be won (won by the States, thus hopefully provide better chance for being won 'by the people') without firing a shot.

Force the FedGov to unhand lands not duly apportioned to the FedGov by the Constitution. Those lands belong to the States, and to the people respectively.

Put some chains around the EPA's feet while we are at it. At the least -- put a strong leash around it's neck, force it to be funded through the Legislature instead of self-funding itself through assessment of fine$.
