Boston circuit court had already ruled in favor, slightly before the 9th circuit judge said no.

This favorable ruling was included in the rebuttal to the 9th circuit IIRC.

So we have one yes and one no.

Four options:

Rewrite the EO,
send case back to 9th,
go to full 9th,
go to USSC
