Exactly right. The judiciary only has the power that the EO or Congress is willing to delegate or “surrender” to them.

I’m not talking about immigration. Immigration is a whole other issue here.

I’m talking about the issuance of travel visas to enter the US, whether for work, vacation, schooling, etc.

The President has discretion on these. According to the 9th circus, cubans, north koreans, and iranians have carte blanche to enter the US at will. Oh, and throw in all of the jihadis from the ME, and all of the mexican drug lords and central american gangbangers too.

I just called McConnell’s office and complained over his silence on this matter. Yeah, yeah I know about the F’ed up GOP establishment but they really need to back Trump up here and come down HARD on the 9th Circuit and ‘PRESIDENT ROBART’. I’m talkin’ punitive action against the court. The Senate needs to take action against this court and reaffirm the president’s right over immigration matters.

Trump must be aggressive and charge forward, no excuses. He needs to be a LEADER. We find out today.

I don't think we will find out at his Abe press briefing. This will probably be about Japanese relations, wouldn't you think? I already think he is aggressive and charges forward.....

seeing as plenty of other presidents have done similar bans without any trouble I hardly would call it “controversial”...the courts decision is controversial if anything

I’ve spent some “quality time” in the late evening watching the Senate “vote” on the various nominees. If you want to see something that is truly a disgrace, go to CSPAN and “tune in!” You will need additional BP medication and a barf bag. ALL OF THEM, both parties are just two buckets of $hit in the same room. If this is the substance of how the US Senate works, I am for abolishing it, or at least removing each and every Senator and starting over!

Exempt green card folks and get the travel ban established. Then make another executive order creating very restrictive rules about who can get a green card. Get that firmly established. Next, start revolting green cards from places that on the travel ban list.

I admit I didn’t understand the controversy over the 17th Amendment (direct election of senators) but in historical context post WWII it’s clear that it’s a huge mistake.

States rights are all well and good but the old system of electing senators would have given the states a voice directly in the upper chamber of Congress in OUR republic. Now a Senator is merely a glorified Representative with massive powers of incumbency and patronage.

He should rewrite the EO to be 99% the same but slightly less restrictive, let them shoot it down, then rinse repeat until they can’t justify shooting it down. Then have them explain the difference from a legal view.

Make them squirm.

And the even greater mistake was allowing the SCOTUS to impose “one man, one vote” on the country, thus abolishing all the bicameral state legislatures, which were heretofore models of the Federal Congress. Since that ruling, the big cities have been able to capitalize on this windfall that gave them total control over the states in which they are located. Here in California, Los Angeles has total control over our legislative process and it’s now Mexico City del Norte so now our legislature is run by a bunch of illegal aliens who openly now tell us that some of their families are deportable under Federal Law.

Hopefully Justice will appoint a litigator who can easily argue both sides of the argument. The one before the 9th got butt-blasted for not preparing for the obvious “touchy, feely” questions from the bench. No way in hell were the judges going to argue on the merits of established law. Countering their made up strawmen and logical fallacies are on the top of the list to attack.

9th Circuit judges don’t squirm. Squirming would mean they have ethics. They are purely political animals. They would just keep issuing TROs or injunctions, no matter how many or how well written any number of EOs are presented.
