Jim if anyone from the White House monitors this site, I would recommend that Donald Trump just withdraw the order and then issue a new one. That would kill the current case and force the Snowflakes to seek a new restraining order elsewhere. Then if it is challenged he can withdraw it and issue a new one.

Not to speak for her, but Laura Ingraham and many of her guest have opined and said tweaking this E.O. to allow green-card holders from these 7 countries to come in ( if my readback is correct ) would do it.
Great idea. I have been trying to raise this same issue. Trump can issue a new EO as quick as they can print them. He can ban all entry into the US by anyone other than a citizen. He could also slightly alter the order to accomplish his goal. I sure hope he does this soon. The breaking up of the 9th Circuit is not the answer and SCOTUS will take too long. As a side issue, Sessions is now AG. He will make sure someone argues in court that has a clue about the law. Like to see him go into Court just to piss off the Libs.
I agree. A bunch of lawyers on Charles Payne’s show were saying the same thing.
One did say something interesting. He said they should ask for an emergency stay from Kennedy and if he ruled for them, then if one if it was appealed to the full scotus and the scotus tied that it would fall back to his ruling rather than to the appeals court.
If he ruled against them, then rescind the old order and proclaim a new one with tweaks in it.
I see no downside to appealing this to SCOTUS ASAP. At issue currently is just the restraining order.
Kennedy may lift the stay, or put it to the court and they will likely lift the restraining order. If SCOTUS declines then there is no point arguing the case since the trial and appeals will last far longer than the ban would have been in place anyway except for Syria. Nothing would have at that point been decided on the merits, and we’d have a soft count on where we stand with SCOTUS if the actual case makes it that far.
