To not fire her is to leave Trump defenseless against all the lawsuits that have been filed. She is a political appointee who serves at the pleasure of the President. He must fire her and assert control over the DOJ. To leave her in charge until Sessions is confirmed (whenever that will be) is to allow the DOJ to be in enemy hands and doing whatever additional things to destroy the new Administration.

Absolutely. This is a trap. The rats made hay of it when Nixon fired several acting attorney’s general in a row. It was called the Saturday Night Massacre.

Trump shouldn’t take the bait.

A better strategy is to appoint an awesome SC justice and force the destruction of the filibuster on that and or Sessions. If DHS is enforcing the EO, who really cares if the acting AG is in agreement?

Plan B would be a recess appointment.

You do what's right. And when the media plays the Cox move, Trump should articulate the point, that the Yates circumstance isn't the Cox circumstance.
