Assuming there's convincing evidence that the kick actually happened the first question is...was it justified.Wearing a burka or being moslem isn't sufficient reason to inflict physical harm.So,if I'm a juror and see convincing evidence of a kick and hear no plausible excuse for it (self defense,for example) I'll vote guilty on one,or more,counts of assault...battery...etc.

But I couldn't care less what his reasoning was...all I care is that he didn't have sufficient cause to inflict harm.

So,I'd vote not guilty on any charge that features words like "hate"..."race"..."religion"...or "gender".
