In 1952, the constitutionality of state pledge laws was brought before the Supreme Court in Ray v. Blair, 343 U.S. 214 (1952). The Court ruled in favor of state laws requiring electors to pledge to vote for the winning candidate, as well as removing electors who refuse to pledge. As stated in the ruling, electors are acting as a functionary of the state, not the federal government.

Can't take anything for granted folks. Wonder if we're headed for civil war.

If DNC does start a civil war, they will soon find out that most of the military and much of law enforcement is not on the side of tyranny and oppression.

True, but the law is what the Courts say it is. The same with stare decisis.

So, assume this gets by the District Court (notwithstanding that there is currently no tort), then understand that the backstop of SCOTUS is not there - it's 4-4, which would leave any Appeals Court decision in place.

So, do we know the makeup of the US Appeals Court that has jurisdiction over Colorado?

You are saying there is federal precedent for removing an elected official from office if evidence of fraud can be found post hoc? Would this apply to the office of president, which the only recourse is impeachment?

I am assuming "post hoc" here refers to the events of November 8, 2016, not January 20, 2017.

We are in that strange period between the election - when Trump was chosen by the people of the several states - and when he actually becomes President.

Impeachment is only a remedy for a maligned sitting official, not one who actually hasn't yet taken office.

I cannot find any precedent for events between Election Day and Inauguration. I think we're in uncharted territory here.

The Electors have one job and one job only. They don’t needs a briefing to know what their state certifies. Podesta and Weiner should be in jail (for a start.)

Gee, you almost would think Podesta would have something serious to lose if Trump gets into office....serious enough they would be willing to start a civil war over their maneuvering if they got their way and stole the election.

I warned people the days after the election that this was too serious for the globalist to let Trump into office even after he won and here we are with them still trying everything in the book to steal this thing.

When this does not work the next option for them to try is even worse but it looks like they control the CIA so it is still on the table. The CIA will be cleaned out if now if Trump sits in the oval office. We are in very dangerous times.

During the Clinton administration Hillary ordered (let’s face it Bill wasn’t there for the power, he was there for the p*ssy and Hillary made most of the decisions) a military strike on a pill factory the day Monica Lewinsky was testifying... Then she ordered a military strike on Baghdad on the day her husband was being impeached by congress... Subverting democracy is something the Clinton’s (especially Hillary) are completely capable of and they (actually she) is the most power hungry individual I’ve seen in my lifetime.

Obama and Hillary politicized the CIA over the past 8 years or so, and most of the top brass have been hand picked to be Democrat friendly... Trump can’t take over soon enough.

I’m sure the Clinton campaign supports informing electors of just how Bernie Sanders was literally cheated out of the Democrat nomination.

I wonder how many potential faithless electors there are on the Clinton side, who really, really would rather have had Sanders?
