You have it exactly backward. A penetrative rape (there is a baby) is now called a misdemeanor.
The victim now has to interact with her rapist because of a plea deal.

It’s right there in the article. Charged with first, plea deal to 3rd. The victim has also testified in front of the Nebraska legislature.
The man was NOT convicted of rape. Perhaps you should be more orecise in your reading.

Nebraska law breaks sexual assault into three degrees,
the first degree being rape.
Sexual assault that amounts to sexual battery (that is, does not include penetration and is not rape) is sexual assault in either the second or third degree, depending on severity.

But, in the same article it does give some details:
In 2011, Noemi was — in her words — a “very naive” high school student with a part-time job at a fast-food restaurant in Norfolk, Nebraska. “I had no idea what sex really was,” she said. “I was just so inexperienced.”
One night after her restaurant shift, a co-worker invited her over to his house, she said, and raped her.
Was it rape or next day buyers remorse? Or even next month? I understand that no means no, but not when you say no the next day.
This is an emotionally-charged and one-sided story. I think that all rational people understand that the media has a problem with presenting all the facts these days.
