'I Have To Text My rapist': Victims Forced To Parent With Attackers By Thom Patterson, CNN November 18, 2016

That's how an 18-year-old Noemi felt when she learned that she had no choice but to hand over her baby daughter to the man convicted of assaulting her.

Noemi's child was conceived in the assault, and Nebraska's laws on parental rights forced her to agree to court-sanctioned visits between her daughter and her attacker.

Noemi with her daughter, who was born after Noemi was raped. Noemi with her daughter, who was born after Noemi was raped. For Noemi, who asked CNN to protect her privacy by not using her last name, it amounts to putting the most cherished part of her life in harm's way.

Her biggest fear is that her child will "get hurt or something bad will happen to her," Noemi told CNN's Lisa Ling. "I can't tell what he will do to my daughter."

Noemi's story isn't unusual. Across America, there are state laws that don't protect women who became pregnant through rape from being forced to share their children with their rapists.

Only with money collected by the state and forwarded to her. She should never have to interact with a court convicted rapist ever again. And he should get zero custody or visitation. None.

Agreed - he should pay be paying the mother restitution. It’s unclear what if anything the guy was convicted of. If it was felony rape, he should have lost all rights to the child - but still pay restitution.

The term assault is freely interchanged with rape in popular lexicon. Its a euphemism. Assault is an attempt to commit a battery. You are assuming a level of technical precision that a news reporter likely does not possess.

It is a sad state of affairs that I have to assume this story is fake news, faux outrage, because of the source and the potential for a political agenda. It seems like the real story here is untold and possibly not outrageous.

The article states that the offender was charged with 1st degree rape (felony in NE) and was given a plea deal for 3rd degree rape (misdemeanor in NE) and this is why the mother is forced into living a nightmare.

Basically raped twice, once by the criminal and again by the criminal justice system.

The sad thing is that the state can, will, and does take children out of the home when the mom tolerates abuse. Abuse counselors encourage women to get out, not only for their safety, but for the children as well. The abuser will eventually begin hurting the children.

In other cases, women have been charged with kidnapping for taking their children and hiding them from the abuser after court ordered custody or visiting rights.

Talk about a conflict of laws huh?

this case is so rare in the western world it should be labeled “endangered”

I have to think the rapist was Islamic because otherwise the courts would demand that the female get an abortion— no questions asked—she’s over age 16 so no parental consent necessary. Less likely scenario would be that the court would order an adoption

In the case of a divorce or breakup, the mother usually gets full custody with the father getting legal joint custody.

For all you men out there that are divorced, you are well aware that legal joint custody means nothing. The mother still unilaterally makes all decisions about the children and collects the child support from the father. Then is given free reign to completely isolate the children from the father deny the father’s visitation rights) No co-parenting necessary.

What kind of rape is a misdemeanor?

In 2011, Noemi was -- in her words -- a "very naive" high school student with a part-time job at a fast-food restaurant in Norfolk, Nebraska. "I had no idea what sex really was," she said. "I was just so inexperienced." One night after her restaurant shift, a co-worker invited her over to his house, she said, and raped her....

When Noemi applied for state medical assistance for her daughter, she was asked to name the father, and the state requested child support from him. Five months after Noemi gave birth, her attacker began demanding regularly scheduled visits with his biological daughter.

The fact the original charge was bargained down and that the court gave the man visitation rights suggests considerable ambiguity in the circumstances. There is no indication in the story whether force was used, what her age was except that she was a teenager, whether she was sober, etc. My guess is that this encounter may have been statutory rape or otherwise fell somewhere in the broad gray area.
