By not holding hearings, the Senate is withholding their consent.
Without their consent the president ALONE can not appoint justices to the supreme court.
It says NOTHING about abdication.

NO, it is not a “RIGHT”, it is a “power”.
It says nothing about “concurrent”.
It takes BOTH the president AND the Senate to appoint justices.
There is no way you can read the constitution on this and determine that the President alone can appoint supreme court justices.
It is not a right; it is a duty. One cannot waive a duty.

This is exactly correct, and I would be astonished to hear that the Republican-led Senate had abrogated it duty and given the Rats the opportunity to fill Scalia’s seat on the Court.
A SCOTUS judge appointed by one president can be unappointed by another president.

What? I don’t think that is correct. Do you have a source for that? I don’t believe it’s ever happened before.
Obama has done a lot of things other presidents haven’t done, and they can be reversed, because he failed to follow proper procedure.
A SCOTUS judge has to be nominated, confirmed by the senate, and then appointed.
Any other way, and the judge ain’t legit.

Yes, LOL!
Sometimes I do a sarcastic post without the /s, and it always comes back to get me.
But in a way I am serious in that Obama has done a number of things using the “easy way”, meaning he couldn’t convince or persuade people to his view point, so he simply forced it on them through various means.
But that’s going to come back to bite him, because since he enacted things using the easy way, they are going to be taken down easily.
Now they suggest the same method for Garland, demonstrating that these people have learned nothing.
