The deputy district attorney for San Joaquin County, Kelly McDaniel, says selling any food not subject to health department inspection puts the people who eat that food in danger.

But if she gave the food away, it would be legal. So it's, clearly, not a health issue but a money issue.

She says it also undercuts business owners who get permits to make their food.

Again, if she had no permit and gave food away, no problemo. Oh, the joys of permits wherein the government takes away a right and then sells it back to you.

No. She couldn’t give it away either. there was an Heirloom seed expo in Santa Rosa and many people were stopped from even giving food away unless they were licensed.

Never fear there’s probably a ban on giving away homemade food too!

Oh common sense where have you gone. By all means label everything with where it came from (duly denoting whether officially approved or not) but cut out the bans.
