If you follow the citations and read the relevant sections of the US Code, there is no intent required.
Furthermore, it's impossible to claim you didn't know there might be classified information in the archive, because it's already known that the server contained classified information.
That almost ensures that the citizens will never see them. There is not much doubt that both sides of the aisle are implicated.

Just having access isn't enough. And distributing them to other people isn't enough, either -- unless you can prove espionage, and that's a very high bar to achieve.
The problem is the SF-312 NDA is a voluntary agreement, and in it the signer agrees to prosecution for violation of the agreement.
Yes, Huma, Hillary, and all of her staff are guilty of violating it. And yes, they should be prosecuted -- if for nothing else, the prohibition on unauthorized removal and retention of classified information. It's a misdemeanor charge that is often offered as a plea deal, after indicting someone for a felony. It also means the government doesn't have to expose the classified information in an open court. But, the fix is/was in at the DoJ.
However, the DoJ could decide to make an example of someone in the NYPD or even Congressional staff for violation of that NDA -- if someone has signed it for other reasons (perhaps former military).
