The justices on Monday turned down an appeal from an Illinois man who failed the test after completing 29 out of 30 untimed pushups.
Jay Bauer said its unfair that female trainees have to do only 14 pushups as part of the fitness test that includes situps, a 300-meter sprint and 1.5-mile run.

Affirmative Action “affirmed” by SCOTUS.I’ll bet the vote was 4-4.
If you can’t do 30 pushups that aren’t even timed, then you shouldn’t be an FBI agent. The only way that could be true is that the guy never practiced at all, even though he knew he’d be taking a test.
And the female persuasion doesn’t do as many, and I’m okay with that, because the FBI isn’t front line combat troops.
They have female undercovers as well as males, and they offer different scenarios in law enforcement.
I saw a young local girl run an 18 minute 3.2 mile a week ago.
Not to mention if you have breasts it’s not nearly as far to the ground...
He has a point. We either have equal protection, or we don’t.
Men and women are equal.
Except where the rules favor women.
I don’t see the practical reason for disparity, especially in situations where female agents face the same dangers as men.
And wouldn’t thirty pushups still be kind of a low standard, especially for men?
If they’re untimed, can you just do one every 5 minutes?
They guy messed up. He should have “identified as a woman” that day, called himself “Joy Bauer”, and he’d be a shoo-in with 29 pushups.
Or ten. Why not?
Sure, if you can stay in the pushup position for 2-1/2 hours.
The other half of that is, who is going to observe for 2½ hours?
For pete’s sake. We had to do 50 pushups, run 1 3/4 miles through sand in 12 miniutes, and do the obstacle course in 4+10 just to qualify for a Navy commission in Pensacola AOCS.
Things must be a little too easy in Comey’s FBI.
The disparity is because the FBI needs female agents since half the nation is female and they investigate crime. They don’t fight wars.
That said, yes, 30 pushups is a fairly low standard for men.
For women, it’s a middling amount. If it were the Army’s test, 30 would only score about 80%. The army’s minimum pass for female pt is in the 19-20 range (60%) depending on age.
Women demand to be treated equal except when they can’t achieve the equal standards. Then they demand favoritism.
None of the military branches require women to meet the same PT requirements as men.
That’s true. And it’s fine as long as it isn’t a combat standard.
When I was active and a fairly youngish chaplain (36), I went to one of my helicopter units in Georgia. There was a ranger detachment at the same location, and they invited us to run with them that week we were there. They were young, qualified rangers.
I like to died, but I made it.
Those guys were not playing by minimal standards.
