Billy Bush wouldn’t have access to the tape. From what I understand, they were miked up to do a segment for some daytime soap. The producers of the soap opera would have been the ones with the recording.
No they were rigged for “Access Hollywood”, of which Bush was a host.

If that is true, this could be considered an illegal wire tapping, if you are not a participant in the conversation, you need permission to record and distribute the material and/or the subjects to be informed that they are being recorded.
correct. This didn’t come from Billy Bush, it came from someone connected with the show. They brought it the the Clinton campaign who decided when to leak it. (my opinion, I have no information)
