A Texas jury took only 17 minutes to convict parolee and former mechanic Duane Buck of gunning down his ex-girlfriend and a man at her Houston apartment, then deliberated about four hours before deciding he should be put to death.
Now nearly two decades later, the U.S. Supreme Court is being asked to look for a third time at whether the death sentence the jury gave Buck was tainted by testimony and evidence related to the fact he is black.
Injecting race into a capital sentencing proceeding is not only wholly improper, it poses a special risk of harm to the defendant, and one that, respectfully, this Court cannot and must not tolerate, Bucks lawyers said in briefs submitted ahead of Wednesdays scheduled arguments before the high court. They have been fighting for years to get a new punishment hearing.

I assume that his demise is shortly....
Good riddance.
Now nearly two decades later......he has been alive for 19 years and 29 days too long.
Just my opinion.
I think I see the problem right there.
The bottom line is the more money you have to spend on your defense, the better your chances are.
But what pisses me off more than anything is when DAs and cops are shown proof the man they arrested and prosecuted is innocent because of DNA or recanting witnesses or admissions of guilt by other parties will say “We got the right man.”
Just how many people does one have to murder in order to make skin color relevant?
Like the priest once said in answer to a question about who his best friend was - “NUN”.
If people do a certain crime they may get a certain punishment.
Moreover, it is pretty much impossible to seat a jury in a capital case to stand in judgment of any minority unless that jury has members of that minority on it.
So if those people are willing to convict ...
... are THEY racists?
... or are THEY easily bullied by eeeevil white jurors?
... or are THEY just willing to convict the sorry Sons’o’****** for what they did no matter their race?
I’m betting it’s the last.
You cannot convict without ALL jurors.
So it is at this time essentially impossible for white people to put someone on death row ... well, at least someone who isn’t “white”.
Moreover, given the incarceration rates with black perpetrators, how they seem to get convicted with great regularity, I’m thinking that black jurors are actually more likely to vote to convict than less likely to convict.
And why not? I mean, it’s not like a minority of black people are’t preying on the majority of black people, making their lives hell if they can. It’s just like what I recall, IIRC, one cop saying about Chicago ... that most of the crime pretty much comes at the hands of 2,000 or so hardened criminals out of a much larger suffering community.
We still haven’t got that express lane....
Texas disproportionately executes whites, not blacks. Just compare murders vs. executions, or even death sentences vs. executions.
DITTO. 1 well placed bullet or a rope would be sufficient.
Heck just OD him on Heroin no shortage of that drug.
