The brief moment they were on would hardly be what one might call being “featured”. None of them looked unhappy about meeting Trump.
I’m not really sure if Fair Use would play into any of this, but I’m sure Trump’s attorneys would know. I’m wondering if they should receive approval from anyone they use in an ad (we used to have a simple 1-page form we used allowing us to use their “likeness” in pictures, videos, etc.). Unless there is something in the police officer’s employment agreement with the city (maybe language about when they were on duty?), I don’t see how it’s the city’s right to provide the right to use a police officer’s face or likeness. They indicated that the city holds the copyright to the badges, insignas, etc. I get they have the right to control the use of those. I’m a little surprised that the city insignia/symbol wasn’t trademarked (I liken it to a company’s logo), but it’s much more expensive than a copyright.
A question I have is was a picture or video of the officers included in a news report (website, TV and/or print)? If so, then maybe the Trump campaign obtained permission from them (I think the news org would be the copyright owners of it).
Bottom line, IIRC Trump is slightly ahead in the polls in AZ and this dude is probably a Dim trying to show how tough he is. I think anyone with a little graphic knowledge could easily remove that from the video if necessary. Again, I’m sure Trump has great attorneys on this - it will be interesting to see how they respond.
