In the video I saw, I could not tell who made the shot. I saw the big guy in the white shirt go down, but, there did not seem to be any reaction from those on scene. Base on reaction, I cannot say a shot was fired. But, eye witness accounts are not reliable.
I don’t think they are going to make the !st degree stick.

Taking witness statements takes a long time, and lawyers are involved as well.
All facts need to be collected and presented, too include factors that might impact on the decision to shoot or not.
Sequence of events, recreation step-by-step of the incident (with timing cues), collating everyone’s videos, recreating each officers point of view (what they can and can not see), and then the question about the thug. . .was he high? Was he tased before the shot or just after? Was he actually reaching for something?
The most confused time when trying to get a factual analysis of a situation is immediately or just after the incident occurs.
Facts and information are just too jumbled within days of the event and with conflicting statements.
These have to be assessed to help determine facts, flow and information, review different/alternate sequences of events and other possible factors that were at play.
These all have to be collected, collated, organized, analyzed and evaluated before taking someone to be indicted.
Do we have all the facts? Most likely not.
As we know there are conflicting reports about when (or if) a taser was fired, timing of the entire event, from first call to final actions, and everything that happened in-between, these are important to know so you may be able to decide honestly if an indictment is warranted, and if so, to what level for the charges. The prosecutor must be able to credibly place a Grand Juror in the officers shoes to accurately assess if the action taken passes the reasonable person test.
Just a couple of days is not nearly enough to time to sort the mountain of evidence related to a shoot.

If the charges are proper, they'd be proper either way.
I have a novel idea here. How about if we let Justice take it's course and see what a jury decides?
A unarmed man has died. Wjether at the hands of a police officer or anyone else, to my mind, that's a fine reason to put it to a jury.
I can't believe they'd charge her without some evidence. It simply doesn't happen very often to law enforcement, so there's likely a valid reason for the exception.

If the victim was white there is only a slim chance he would have been shot to begin with.
She shot an unarmed man who was not a threat to her or anyone else in the area. I think that calls for a bit more than a misdemeanor.
Does anyone know if the driver had a weapon? These charges might make sense if he was unarmed. I can see how a defense lawyer can make a case that she feared for her life.
Also, did any other policeman discharge their weapon?
Just heard CNN lawyer talking about PCP being in the car and if the jury hears that evidence it may be a game changer.
To my knowledge, a taser was used by one other officer. No other gunfire. I don’t believe the driver was armed when he was shot.
There were 4 cops on him, 3 were taking a bead on him. Anyone who thinks the victim could have pulled a gun and taken out 3 cops is a fool.
This is another case where the unachievable and unrealistic practice of 100% "Officer Safety" failed and another citizen is dead.
Was the guy obeying orders? No, was he a threat, no.
Police just stated there was no weapon.
She must very much now regret going into “criminal justice”.

It seems substantially more likely this decision was made not by the police, but by the DA, who presumably would have had statements from all the cops involved, as well as other information, like the video(s), to assist in his decision-making.
Why would anyone take a job where making a mistake means prison? I wouldn’t.
That’s what I thought too. He tased the guy.... Seemed she overreacted. Not saying I wouldn’t have done the same thing though. Just a bad situation. We have to stand behind our police.
It may be proverbial "Scottish verdict" time. She skates, but never ever has a police job again.
This statement takes me back in time living in England. In a murder trial in England it was "Guilty" or "Not Guilty." Scotland had these two alternatives as you will know but also "Not Proven". It meant the case could be revisited.
I had an experience as a raw conscript soldier patrolling on guard duty at night. This on the Suez Canal. All alone. But for the bolt action on the 3.03 Lee Enfield which required three separate movements before firing, I could have shot someone once. Oh, well, not the place for these yarns really.
