I’m no fan of Nakoula, but you seem to be forgetting the issue here. And that is he was basically railroaded just for having made a lousy video. He was sent to the slammer supposedly for inciting the carnage in Libya, which he didn’t do. He wasn’t a innocent man, but he was innocent in this one matter.

I think you’re making a common mistake which is unsurprising because the press constantly misstates the facts of his arrest at the time of the video.

Nokoula was arrested for being in violation of his probation on the bank fraud conviction. Because of his conviction for having committed bank fraud he was prohibited from using aliases and making false statements, and the news about him and the video revealed the fact that he had been doing both. Granted that the video controversy alerted his probation officer, but the arrest wasn’t for making the video.
