The Equal Employment Opportunity Commission is considering whether wearing clothing in the workplace with the Gadsden flag printed on it constitutes legally actionable racial harassment.
According to Eugene Volokh, a UCLA law professor who runs the Volokh Conspiracy blog at The Washington Post, the EEOC ruled two months ago that it will need to collect more evidence in a case filed in Jan. 2014 by an African American federal employee who complained about his coworker wearing a hat with the Gadsden flag printed on it.
The complainant said that the Gadsden flag, which was designed during the Revolutionary War in 1775 and has become popular with the Tea Party movement, is racist because its designer, Christopher Gadsden, was a slave trader & owner of slaves.
And though the complainant made no claim that his coworker made any racist remarks while wearing the hat, he said that the Gadsden flag the iconic yellow banner, which shows a coiled rattlesnake above the words Dont Tread on Me is a historical indicator of white resentment against blacks stemming largely from the Tea Party.

The Gadsden flag represents nothing more than a contempt for central authority, and a symbol of independence from same. That is what it was originally, that is what it is now. The only things that have changed are:
1) The original central authority that it was aimed at was the British government and King George, whereas the present display of that flag are now aimed at our overbearing, interfering, power-usurping federal government - the one that no longer represents us, as England no longer represented us as of no later than 1776; and
2) Now there are a bunch of ill-educated, benefit-seeking, moronic special snowflakes that couldn’t find their asses with two hands, and who wouldn’t know actual history if it ran them over.

These snowflakes, these pussies (to quote Clint Eastwood), don’t know what real hardship is, nor do they truly understand what it is that their ancestors went through. To them, a hangnail is cause for missing a week of work and calling one’s lawyer.

Why does equal always mean create a protected class with extra rights for certain people? It’s like they’ve never looked at a dictionary before.
On the same grounds, the US Constitution is racist (2/3rds count) and the image of the Minuteman is racist (they were all white). The complainant is seeking to declare all non-left THOUGHT an indicator of a hostile workplace. I wonder if this workplace is the IRS? Dangerous to have someone working there who is not a true-believer!
I reckon said complaintant has no problems with the congressional black caucus... a racist group if there ever was one.

Actually, my error it is 3/5ths count, not 2/3rds count in the original Article I, section 2, clause 3. And as all good FReepers know, it was to prevent Southern Slaveholders from getting greater representation in the US House by counting their non-voting, non-citizen slave populations as equal to the populace of the non-slave states.
Few people know that there were white slaves too. Some of them were owned by Blacks.
